We have seen videos of Jenn Wambolt being attack by the staff at the Justice Building but I was never there to witness these confrontation.

I decided to show up in Court around 1:00pm. I didn't go with anybody, I just showed up and the Sheriff always asked me - Are you here on business or a observer?
This time I was an observer < media > so I wasn't search. I don't make it a habit of going into this Building because it gives me a VERY sick feeling inside my stomach.
You see these appointed Judges walking around as there were Kings but deep inside I know the less fortunate do not stand a chance in Court. < Ok...never mind that issue >
Six people were all gathered in the hallway from the Court Room of Racist Judge Mary Jane Richards. This is the same Judge that signed the Cops to raid my place under the Child Sexual Exploitation charge. She also signed a few warrants under the Criminal Code 301! She works VERY closely with our Racist Police Force.
The reason Jenn was in Court is she canceled an appointment with the ok of her Probation Officer. Once the Fredericton Police Force found out she missed an appointment? They quickly charged her.
Now...the VERY strange part is Fredericton is the only area in New Brunswick where if a person breach a probation order or breach the impossible conditions set by the Fredericton Police Force? You immediately go to Jail for 30 days.
I debated this SAD issue with professionals from the Law Society and they told me it was true!!!
Other areas in New Brunswick don't order jail term but Fredericton does.
THE QUESTION IS WHY???
We know there's a snobby attitude towards the the less fortunate and this proves it.
So there was Jenn and her husband waiting to see what was going to happen? Everyone had ideas or suggestions but of course we are not recognized by the Courts so our views don't matter.
But I did tell Jenn that once Mary Jane Richards asked her- Do you understand what's going on?
Tell the Judge that you don't!!!!
Jenn didn't want to plead guilty because she was in Court when I was forced to plead Guilty on January 16th. She saw the Cops pleading with me to plead Guilty. < Racist Cop Cpl. Bobbi Simmons-Beauchamp. >
Three days later the Racist Fredericton Police Force raided my place.
Her duty Counsel wanted to have a chat with Jenn and her husband before the Court proceeding began.
They were in that room for over 20 minutes and I guess it was emotional.
Once they came back in the hallway, everyone wanted to know what was going on????
Jenn told her supporters that the Prosecutor told her lawyer that he was giving her two choices -
1- Go to Jail for 30 days?
2 - Go to the Mental ward in Restigouche for 30 days?
I guess Jenn's husband said - I know that my wife is coming home with me today!!!
Well......nobody seen that one coming.....Jenn was given a choice but without any trial. Anyone was upset...an older Lady insisted we cause a disruption in the Courts because enough is enough!!!
I quickly reminded the group that I was just an observer so I can't join any protest. But it sure was tempting because this was Racism in action against the less fortunate and people who have a mental problem.
Of course some would say - Charles? It's not Racism!!! It's elitism or discrimination!!!
Well.....this has been going for years and it's time that we call it for what it is!! Racism or Facism!!!!
The Sheriff came in the hallway and told Jenn that the Court was ready for her.
Jenn began crying of the fear of walking in there to face Racist Judge Mary Jane Richards.
It reminded me of someone going for their execution!!!!
This Scotsman is tough but this really bothered me. Here's a Mother of three kids and never been in jail but the system told her that she was going to be locked up for 30 days without a trial???
The system SUCKS!!!!
Another individual who was watching the situation very closely was so-called Irving Journalist Don Macpherson.
I told the guy - TRY TO COVER THE FACTS WITH THIS ONE OK???

Once in court, we sat and waited for the Racist Judge to make a showing but to everyone surprise it was a new Judge.
Lots of surprise in the Justice Building today eh???
It was Judge Pierre Dude!!! A Judge from Moncton.
The Prosecutor Claude Hache quickly demanded that Jenn Wambolt be sent to Campbellton for 30 days for a mental review.
I might add that it was VERY difficult listening to this guy insisting Jenn goes directly behind bars!!!
NOT GOOD!!!
The Judge said - I'm not going to sent a citizen to jail without statement from a doctor or other medical professionals.
But the Prosecutor continued insisting Jenn go to jail for another 4 to 5 minutes until the Judge told him that he has heard enough.
He ordered a new court date and Jenn will have papers from her mental health doctor.
Everyone was happy but Jenn knew that this was just a delay tactic. But maybe common sense will arise in this case? I doubt it!!
Who truly knows?
Thank God it wasn't Mary Jane Richards because Jenn would have been behind bars!!!
The Judge left and everyone gathered for a sort of a celebration. Jenn was going home and not in jail.
I went to the washroom and once in the hallway, I noticed Jenn and her supporters heading my way so I walked upstairs.
Once at the main entrance, I had a little chat with the Sheriff and I noticed So-called Irving Journalist Don Macpherson near-by.
I didn't bother talking to him ever since he publicly called me a Litigant in the Daily Gleaner.
I was wondering where was Jenn and her supporters???
I decided to return downstairs and it was Chaos!!!
This is what happened!!!
While walking away from the Courtroom, Racist Fredericton Police Officer CST Paul Estey approached the group!
He quickly interrupted the little celebration by saying - Jenn? Your Husband have $25.00 in unpaid fines!!! Pay up or he's going to jail!!!

What really bothered me in this case is the fact the Cop knew that she was in court and she had mental issues.
Why not wait? Why now?
I was surprised there were little security in the Court Room? Maybe they expected Jenn to freak out after the Racist Cop approached her husband unpaid fines?
Maybe there were all waiting in a room and once she began screaming? They would rushed outside? Who truly knows?

This Blogger had a VERY sick feeling in his stomach. I witnessed what happened and it sickens me to death that the corrupted system wanted to sent Jenn to jail for 30 days.
I went for a haircut and walked into someone home and said- GIVE ME A DRINK!!!
I now understand why some Lawyers have a drinking problem!! This is Bullshit!!!
I began drinking at 3:00pm and continued till the late hours.

Even if the Fascist Members of the New Brunswick Court of Appeal ruled last month that the Cops can do their dirty work inside the Court Room!!

This indeed is puzzling.It would appear, based on the info contained in Charles story, and in the Irving press that in fact, this judge has a brain is is doing his job. Bravo Sir!!The crown prosecutor is/was looking for a 30 day appraisal/time out/ whatever term is appropriate for Ms Wambolt.
My question is, what good would that do for society? What good would that do for this ladys family unit and herself?
Thank God, the judge in this matter dismissed this wasteful,unintelligent barrage and decreed another position. As often said, common sense is not very common anymore, this judge has used some valid common sense to gather info to make a decision.I wish only the best to this lady,and family, and as well, wonder as Charles does, how does the Crown come up with this?
Acting FPF Police Chief Fitch is on record as stating that special measures are needed in dealing with certain situations citizens find themselves in. Let us hope a fair decision is reached, and Ms. Wambolt finds peace with it.

Don and I had battles in the past but he decided to make it public.
He used that word in a bad way and the Board of Editors at the Gleaner agreed because I wasn't allowed to write a letter to the Editor against his story.
I might add many citizens are denied to write letters against the paper.

I read about your comments on Cst Estey today.
I stopped at his office to see what I had to do in court with
reference to my son's plead date (Last Sep) when he was attacked by a
bully and got charged for fighting.
Cst Estey was rude and condescending towards me. He was clearly
annoyed that I was to go to the ticket window across the hall. It is
fortunate I am a Veteran and have respect for the uniform, had it been
anyone else I would have informed him loudly to treat people with
respect. For a man of the uniform, I was less then impressed, in fact
it was disgraceful to see how everyone was treated by him.
The next time I showed up it was with a criminal lawyer, funny how
people with money (and lawyers) are treated, and those that are not
are treated like crap. Cst Estey should treat all people equal.
Well, again, technically Charles is not a litigant as that typically pertains to civil court, not criminal. When you call somebody 'litigous' its not exactly a compliment.
However, in the long run there are lots of worse things Charles has been called, and lots worse things than not printing letters that the Irving press has been accused of.
But good coverage of the story Charles. If you want to know 'what other cases this is happening on' then by all means drop by and write a story on them.
Good comments 12.09 -y experience also. 11.18 - we have been through this and you did not bother to read or accept the facts - Charles was an accused and a defendant but he was NOT a litigant in the way Don MacPherson used the word in respect of Charles, where he incorporated Charles with a group of self-represented parties in civil court. Charles has no choice but to defend himself in criminal court, unlike the self-represented parties in civil court refered to by MacPherson. I agree with Charles - he was not a litigant, he was a defendant.
11.32 is spot on - when are these issues going to be investigated, especially when the AG herself says the system is failing in particular the mentally ill or challenged.
I was at the heawring and I am interested that the Crown Prosecutor not only had no medical evidence to support his request that Ms Wambolt be involuntarily detained for 30 days in an institution but he also presented to argument or case law to support this course of action thaat he was seeking a court order for.
Kary Jane Richards has obviously recused herself from these issues and her replacement, Pierre Dube, did the right thing - which the Crown Prosecutor was obviously not expecting, having told the counsel for defense the choice for Jenn was 30 days incarcerated in jail or 30 days incarcerated in a psychiatric facility -without any trial or hearing to validate the merits of either option, which opposes all of the principles of fundamental justice.
Crown counsel, Claude Hache, was negligent and obviously under instructions to get Jenn put away one way or another.
Time for a complaint to the Law Society and the Director of Public Prosecutions, Luc LaBonte and AG Marie Claude Blais, who are in charge of the Crown Prosecution services. These people are wasting tax payers money pursuing the ill and the poor and allowing murderers to walk the streets.

I doubt very much that anon has been through anything close to what Charles as other members of society have been involved with. Fortunately, it only takes about 20% to change the world, what is always sad is it is usually the 80% who enjoy the benefits of the work of the 20%.

I haven't been through what Charles or jenn has been through, because I won't put myself in the position to do so.
I take responsibility for my actions, and pay the consequences, thus not needing to be a defendant. In other words, I obey the law, no ,after how dumb it is.
They may not have started the court action, however it was their actions that required court action to deal with their wrong actions.
When the police start hauling random people off the street, and they go to court without an charges
Aid against them, then I'll support them. As that has never happened in this city, this whole wasting of time by the Charles and Jenn's is frivolous and ridiculous.
I won't support people who violate laws and bylaws and land in courtbecause they have done so.
Us people that behave, or pay the fines when we do violate a law or bylaw, or walk away if we get punched, or a broken hand, and pay the price ourselves, insteadof making society do so for our actions, or the resultof our actions are more than tired of this waste of the courts time because people won't simply take responsibility for their behaviour.
If I'm dumb enough to put myself in a position my rights get violated, that is my own damn fault, and not societys to waste money and time on.

Even in third world dictatorships police grab the Charles' of the world-the troublemakers. They grab journalists and politically active church members.
Those who don't challenge police are too valuable, they will do the work of continuing the society even while its turning into a fascist police state. To use Charles favourite example, white middle class germans had no reason to fear the Gestapo. I'm not equating the two, but its worth reminding that panhandlers ARE 'disappearing' from the streets for doing something constitutionally protected in EVERY other province-just like 'being homosexual' or 'being jewish' resulted in jail, and worse. Its also worth reminding people that homosexuality was also illegal in Canada until 1968.
Now, you may sleep fine at night thinking "well, they aren't jews" or "they aren't being killed" or "its ONLY for a month". But those are only differences in level, not differences in kind.
YOU will never have to worry. And chances are good that even if random people were grabbed, then the police account of whatever they were doing will be enough to satisfy you-as it is with panhandlers right now in NB.
In Saint John when Charles was arrested it was FAR worse than being 'random'. He was doing absolutely nothing wrong but taking pictures for a blog and a judge clearly said his rights were violated. This is EXACTLY the thing which we criticize third world dictatorships for. So the types of things you are talking about are ALREADY going on..you just don't care enough about those involved.
I'll admit I can't make heads or tales of Jenn's story, and unfortunately once 'mental illness' comes into it there is an onerous burden of proof on a person to provide evidence-but its certainly clear even from the Gleaner that it wasn't HER who was there 'wasting tax dollars'. She was there because she HAD to be.
But you're perspective is VERY clear. You think 'putting yourself in a position where your rights may get violated' is 'dumb'. That says it all. This is Canada. The whole point of the rule of law is there are NO circumstances where your rights are to be violated, and it certainly isn't 'dumb' of such a person. That would essentially mean we can never leave our homes because 'our rights MAY get violated' and you were DUMB enough to be walking down the street.
In short, I hate to agree with Charles on a point, but you are either a member of the police or government trying to 'justify' what is unjustifiable, or else you really have no reason to be at this blog, let alone posting on it.

Therefore I wouldn't need to get ticketed,or need to fight the ticket.
Does needing to wear a helmet violate my rights? I don't really care, in the grand scheme of life wearing or not wearing a helmet is hardly violating any important right I may be entitled to in Canada.
If I were to ever doing and get caught,I'd pay whatever fine and gain not need to be tracked down, I certainly wouldn't waste the worlds time fighting it because I was dumb enough to do not wear a helmet. I also certainly wouldn't say "look, everyone else does it" because it hardly matters what everyone else does.

If say I was taking pictures as Charles was in SJ, first, I'd seek permission before taking any pictures. If I was asked to stop, I simply would, even if I had the right to take them. I'd then fight the process after the fact, misread of making a scene at the time, and therefore never bumping heads with authority.
It's very easy to do the right thing and stay under the radar, and still fight the system properly. Rather than confrontationally.
Same thing, if an officer wants to handcuff me for any reason. Go ahead. I won't resist. There's a time and a place for that, and it isn't while be handcuffed.

Just because something timely is happening, does not mean you can do whatever you want because it is a time sensitive issue.

It would have been unfortunate had. I been in the mall like you, that I would have missed having a picture. Because iWork's hqve seeked permission first from the mall, and then from any officials present before I even thought of taking a picture.
I would have also lived, not having a picture of the event, wouldn't have really made a difference at all in the grand scheme of life.
Maybe some document out there even gives me the right to just take the picture. I still wouldn't. I have enough of a moral compass to know just because I might have the right todo something, that perhaps I should still seek permission from the stakeholders before i do something.

Could you just see anyone telling a judge to hold up the proceedings so you could run out to feed a meter? Jenn's tickets were NOT legitimately processed, being commenced as a criminal and not a ticket offence, which involves the City lawyers, judges and police in corruption, negligence and breech of public duty. What does it matter what anyone else did or gets away with? It doesn't. I'm not going to say anyone is ever justified because others do it, even the Governemnt. It doesn't make the action magically okay because others do it as well.
My kids tried that lamest of lame excuses ONCE on me. Trust me, after that was tried and failed they not only never tried it on me again, but not ever again on any extended family, friends or now co workers. That lesson was more than learnt. Their kids have never tried it after it being made clear a t a young age such actions would not go over well.
