Supreme Court won't hear appeal of Fredericton murder case

The Supreme Court of Canada refused Thursday to hear an appeal of a Fredericton murder case.

Zachary Flowers sought an appeal of his second-degree murder conviction for the shooting death of Jacob Brooks in 2003.

Brooks, 29, was driving home from the Fredericton wading pool with his two children in the car when he saw an acquaintance in a fight on Jaffrey Street near St. Mary's First Nation and stopped to help.

A shot was fired; Brooks was fatally wounded and later died in hospital.

Flowers was sentenced to life in prison with no chance of parole for 12 years in 2004.

The defence requested an appeal on the basis that the trial judge had erred in refusing to instruct the jury on the defence of accidental discharge.

According to court documents filed by Flowers' lawyers, he had gone into his home to retrieve a shotgun after becoming involved in a shouting match with another individual.

When Flowers returned outside with the gun, he found two other men, including Brooks, had become involved in the altercation.

Flowers had not checked to see if the gun was loaded, according to the documents.

It discharged, shooting Brooks, after another men stumbled into him during the fight, said the documents.

Flowers handed the shotgun to another person with instructions to dispose of it and fled the scene. He was later captured in Saint Leonard.

The Supreme Court of Canada is not required to provide its reasoning for refusing to hear an appeal.


Now, the widow let a white boyfriend moved in so this is the reason the Council ordered her to move out.

She's also white but the two boys are half Native and live on the Reserve all their life.

Is this right????

Over 200 Natives off reserve are on the waiting list. A senior will move in.

Abel told an Irving's soldier ..opppsss I meant Journalist.

This is the quote - We will take it back, and it's got to come from the grassroots and real leadership," said LeBlanc, a former longshoreman, on Tuesday.
"I would only recommend that they do it peacefully. Somewhere down the line it will come to protest and violence."

The Irvings are allowing comments on their website to crucify this outspoken MLA!!!

The Irvings are calling for Shawn Graham to kick Abel from the Liberal Party!! They strongly urge the Premier to have a chat with Abel.

Abel LeBlanc is 100% right in his words.

An overweight guy with a black helmet on his head stood at the door and shot a striker dead!!!

There was a big inquiry afterward and the verdict was – If there would have been an Anti-Scab law in place? This sad episode would have never happened!!!

Abel has the right to give his predictions on the future and the Irvings should respect his line of thinking.

YOUNG PUNKS FIST FIGHTS ON THE FREDERICTON WALKING BRIDGE!!!!

I noticed the sun breaking through the clouds so I quickly went for my walk to enjoy the sunset.






While on the bridge I noticed a drunken individual standing on the deck.

This guy is totally harmless. I was surprised to see him on the bridge???








I walked by and said – You lost????

These individuals usually stay in the downtown core and not on the bridge.

He was reaching out to the people walking by enjoying the nightly walk.







I said to myself – Ohhh Boy!!! I wonder how long it'll take for someone to call the cops???

I continued on and took a few pictures.






Suddenly I heard a Police cruiser flying by. I decided to take a quick shot.








Then another one speed by.








I ran to the road to see if the action was close-by?








Then suddenly the police Truck flew by.

Also a ghost car.









My God? I believe that I need a horse to follow the action.







They took a left turn on Union Street so I quickly followed.

I decided to let it go!!!! It ruined my sunset pictures so I decided to go back on the walking trail bridge to go home.

I was surprised to see these cruisers on the Walking trails.






I was really confuse. < not the first time > Someone attack a female? The Police are chasing the guy in the woods???

One woman was crying. I couldn't hear the whole details of the conversation.









Something like this? I stay back and let the Police do their job.

I'll get my answer later.

Once they were done, I asked the women of what just happened?

They told me there was a huge fist fight on the Fredericton Walking Bridge.

I continued walking towards the Bridge and an officer told me the same story.








I asked if it was a drunken guy with a hat?








I was certain someone attack the poor drunk.

I was told it was some punks who had a few drinks and a fight pursued.

I continued my walk and this is one sight you never see on the trails.








Hey? Thank God, it was paved eh?






My God? Another cruiser????








I noticed two officers walking towards me and they must have known that I was going to asked a few questions?







The officer acted as he was talking to the media – We had an incident on the walking trail bridge tonight. One youth was drinking and a fight pursued. The citizens enjoy walking the bridge in a safe manner so we acted accordingly!!!

One guy was arrested I guess?

Yes, I told you readers that the young punks were getting bad and this proves my point.

I must have missed the whole episode by 5 minutes. < walking too fast >

Yes, the Fredericton Police Force sure moved fast on this one.

They're keeping this City safe but for how long?
